Terms & Conditions

Welcome to House of Play, prior to completing a booking and making payment, please read the following terms and conditions carefully.

In this agreement the Person/Company hiring equipment from House of Play will be referred to as ‘The Hirer’, The Company, House of Play, may be referred to as ‘Owner’, ‘We’, or ‘Us’.Booking/collection date refers to the date and time specified in the order confirmation. Equipment means the items of play (including our bouncy castles) specified in the order confirmation.

Damage means any damage to the Equipment, including but not limited too:

 

- Damage to equipment due to being left­ in direct sunlight/rain.

- Damage to the structure of the equipment due to incorrect use.

- Damage to the EVA mats due to high heels, pegs, and chairs.

- Damage to the equipment or EVA mats due to face paint, glitter or colour markers.

 

These Terms and Conditions agreement acts as a legal contract between House of Play (the Owner) and The Hirer.

The Hirer understands and acknowledges that under no circumstances will House of Play be held liable for any injury caused by the use of Equipment supplied and the Hirer hereby releases House of Play from any loss or damage.

It is recommended to keep a copy of these terms and conditions for your records.

  1. HIRE

 

1.1. The Hirer agrees to hire the soft play Equipment and/or bouncy castles from the Owner, for the Term on the terms of this Agreement.

 

1.2. The Hirer warrants that they have inspected the Site and determined that the Owner will have safe means of access to safely install soft play equipment and/or bouncy castles.

 

1.3. The Hirer may only use the soft play Equipment and/or bouncy castles for its Permitted Use.

 

1.4. The Hirer must not move the soft play Equipment and/or bouncy castles.

 

1.5. The Hirer must not remove the soft play Equipment or bouncy castles from the Site and must ensure that the Equipment is secure from theft, damage/destruction.

 

1.6. The Hirer must ensure that the soft play Equipment and/or bouncy castles are not soiled by, or allowed to come into contact with, food, drinks, animals, cigarettes, face paint, chewing gum, party poppers, coloured streamers or any item (including but not limited to sharp objects) that may cause damage or harm to the Equipment.

 

1.7. All soft play Equipment and bouncy castles must be used in accordance with its manufacturer’s operating manual.

 

1.8. Soft play Equipment and bouncy castles are not to be used if at any time during use any part of the Equipment is damaged or wet.

 

1.9. No adults are to enter, and use the bouncy castles or Soft play Equipment.

 

1.10. Children are to remove footwear before entering the bouncy castle or Soft play Equipment.

 

1.11. Children are to wear socks while using the Bouncy castles and Soft play Equipment.

 

1.12. Hirer is to ensure that there is a supervising adult 18 and over AT ALL TIMES on all soft play Equipment and Bouncy castles 

 

1.13. Hire is to ensure that Equipment is not overcrowded. 

 

1.14. If the blower component of the bouncy castle stops working, all children are evacuated promptly and the Owner is immediately contacted.

 

1.15. Without prior written consent from the Owner, the Hirer is not permitted to attach balloons, vinyl stickers or any other form of Custom decorations or attachment to any of the Equipment/bouncy castles.Requests can be sent through to houseofplayinfo@gmail.com

 

1.16. It is the responsibility of The Hirer to inspect and check all equipment and notify Owner on delivery if there is any equipment missing, unfit for use or damaged. Failure to do so will see Hirer responsible for any damages or missing equipment on pick up.

 

1.17. The Hirer grants the Owner irrevocable consent to enter the Site in order to collect the Equipment.

 

2.  DELIVERY

 

2.1. The Hirer must ensure that access is clear and unrestricted so that the Equipment can be delivered and set up safely. An additional fee may be charged if the set up area is 50 m or more from our delivery vehicle.

 

2.2. If a bouncy castle is being hired, It is the responsibility of the Hirer to check that ceiling clearance is a minimum of 3.5 meters and set up area is a minimum of 1 meter to each side. 

 

2.3. It is the responsibility of the Hirer to contact council to gain consent for the use of equipment on public property. The Owner will not be held liable for any costs/penalties incurred. This includes local Government fines, towage fees, or impoundment costs whilst in the use of the hirer.

 

2.4. If the Hirers event location is within Onehunga to Franklin region , delivery, setup/collection will be included in the total hire cost.All other Auckland suburbs will incur a delivery fee. This will be charged at 90 cents per KM return trip (routes are calculated via Google Maps) if you are unsure about your location please contact us so we can assist you.

 

2.5. Earliest delivery time is 8:30am, latest delivery time is 4:30pm. Latest collection time is 8:30pm. Overnight  bookings will be considered for indoor events only, this is on a case by case basis.After service bookings will be charged $50 per hour.

 

2.6. A minimum booking value of $500 must be made for bookings outside of our free delivery zone. (Onehunga to Franklin region) Please note this does not include delivery charges.

 

 

3.  HIRE FEES, REFUNDABLE BONDS, LIABILITY

 

3.1. Hirer must pay 100% of the Hire Fee.Hire Fee may be paid by direct debit or electronic funds transfer into the Owners nominated account.                 

 

3.2. A $200.00 refundable bond is required for each Hire Period. This is payable in cash on the day of Hire and will be refunded when the Equipment is collected in the same condition they were hired out.

 

3.4. The Owner will be entitled to claim, in addition to the Hire Fee, a cleaning fee of $200.00 from the bond if the Hirer returns equipment dirty requiring extra cleaning.

 

3.5. The Owner may retain the Bond to fund any cleaning or repair/damage costs payable pursuant to this Agreement. If the Bond is insufficient to cover any such costs, the Owner may take action to recover the shortfall. The minimum replacement costs of soft play equipment is $500, and Bouncy Castles carry a minimum replacement cost of $1,000. In the event of equipment being stolen, the Hirer must provide a police report confirming this.

 

3.6. If the Hirer fails to pay the damages to the Owner within 14 days of notification of repair/damages, the issue will be referred to a collection agency. The Hirer will be liable for all costs involved.

 

3.7. The Hirer acknowledges that they bear all risk in the equipment for the full duration of the Hire Period.

 

3.8. The Hirer must be present at the completion of set up. The Hirer will be required to inspect the equipment and sign a rental contract that will outline the existing condition of equipment including any existing defects.The hirer will also be informed of the safety, hygiene and equipment guidelines.

 

 3.9. If the Equipment is damaged, the Hirer must notify the Owner and provide details of 

any damage immediately. If the damage is caused by any breach of these terms or negligent acts of the Hirer. The Hirer will be held responsible for any replacement/repair fees.The Owner will take care of facilitating all replacements/repairs of the Equipment and the hirer will be charged accordingly.

 

3.10. The Owner has the right to alter/change prices without notice.

 

 

4. CANCELLATION POLICY

 

4.1. If the Hirer chooses to cancel a booking, the following will apply:

  • Cancellations made at least 10 days prior to the event will receive a full refund, this will be processed within 48 hours, please note this is excluding the 20% non-refundable deposit payment.

  • Cancellations made within 4 - 9 days of the event, will incur a fee of 20% of the total booking, the remainder will be refunded within 48 hours.

  • If less than 3 days notice is given, full booking costs apply, and no refund will be issued.

 

4.2. Change of booking date will be accommodated to the best of our ability. However the hirers original Equipment choice is not always guaranteed. We will however, do our best to offer similar options. Change of booking date with less than 14 days notice will be charged a fee of 20% of the booking which must be paid in full. New booking dates must be within 6 months from the original booking date.

 

4.3. The owner can operate during alert level 3 and below, if the booking is cancelled due to COVID restrictions the Hirer will be given the opportunity to reschedule for another date.

 

4.4. Cancellations due to unsafe weather conditions ( heavy rain, winds exceeding 20 km/ph) the Hirer will be offered credit to use within 12 months from the cancellation date.

 

5. SAFTEY GUIDELINES/PLAY TIME RULES

 

PLAY TIME RULES

 

  • The Hirer must ensure that equipment is supervised at ALL TIMES by a responsible person over the age of 18 (eighteen). House of Play does not provide supervision.

 

  •  All Equipment are strictly for use by children under the age of 6 years. Under no circumstances should ADULTS play on Equipment.

 

  •  For safe play there is a maximum of 6 children at one time on 3x3 bouncy castles.

 

  •  No climbing on/over bouncy castle walls

 

  • No food, drinks or chewing gum is allowed on Soft Play Equipment and/or Bouncy Castle(s)

 

  •  Shoes MUST be removed before using all Soft Play Equipment and/or Bouncy Castle(s). Parents/Guardians who enter the Soft Play area must remove their shoes. (particularly heels)

 

  •  For hygiene reasons, socks must be worn at all times whilst using the Soft ;Equipment and/or Bouncy Castle(s).

 

  • Equipment and/or bouncy castles are not to be used with water.

 

  • No sharp objects are to be taken onto any equipment and/or bouncy castle(s) 

 

  • No face paint, party poppers, glitter, coloured streamers, silly string or colour markers on any equipment.

 

  • No acrobatics or gymnastics to be performed on the Soft Play and/or Bouncy Castle(s).

 

  • All potential fire hazards to be at least 4 meters from all equipment.

 

 

By making payment for your booking, you are acknowledging that you agree with the above terms and conditions for hire.
